How to Submit a Notice of Infringement
Send a written notice to the designated agent above containing all of the following (per 17 U.S.C. § 512(c)(3)):
- A physical or electronic signature of the copyright owner or their authorized agent.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material that is claimed to be infringing or the subject of infringing activity, with sufficient information to permit us to locate the material (URL or in-product path).
- Information sufficient to permit us to contact you (full name, mailing address, telephone, email).
- A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.
Knowingly material misrepresentations in a § 512(c) notice may subject the sender to liability for damages under 17 U.S.C. § 512(f).
Counter-Notice
If you believe content was removed in error, you may submit a counter-notice to the designated agent that includes (per 17 U.S.C. § 512(g)(3)):
- Your physical or electronic signature.
- Identification of the material removed and the location at which the material appeared before it was removed.
- A statement, under penalty of perjury, that you have a good-faith belief that the material was removed as a result of mistake or misidentification.
- Your full name, mailing address, telephone, email, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which the address is located (or, if outside the United States, the U.S. District Court for the Middle District of Florida) and that you will accept service of process from the person who provided the original notice or that person's agent.
Repeat-Infringer Policy
Project College terminates accounts of users we determine, in our reasonable discretion and in appropriate circumstances, to be repeat infringers. We define a repeat infringer as a user who has been the subject of two (2) or more confirmed § 512(c) notices within any rolling twelve (12) month period that we have honored by removing or disabling access to the identified material, where the user has not successfully prevailed on a counter-notice.
We may also, in our sole discretion, terminate any account at any time for any conduct that we determine to be a violation of our Terms of Service, including content scraping, model-training misuse, or other conduct described in Terms § 5.
A user whose account is terminated for repeat infringement may appeal by emailing [email protected] within thirty (30) days of the termination. We respond within fifteen (15) business days. We may reinstate access only where the user demonstrates that the underlying notices were materially mistaken or have been withdrawn.
Trademark and Other IP Notices
Trademark or other non-copyright IP claims should also be sent to [email protected] with details of the asserted right, the allegedly infringing material, and a statement of your authority to act for the rights-holder.
